General Terms and Conditions


1. Definitions


1.1 In these terms and conditions the following terms shall have the following meanings:

  • Dog Balance: the service provider
  • Owner: the natural person who uses the services of Hondbalans
  • Subscription: an ongoing agreement for purchasing services on fixed days


2. Formation and Nature of the Agreement


2.1 An agreement is concluded by signing the intake form during the intake interview.

2.2 Subscription terms:

  • Is entered into for an indefinite period
  • The notice period is one calendar month
  • Cancellation only in writing or by e-mail
  • Subscription is personal and dog-related, non-transferable

2.3 Termination will take place on the last day of the calendar month and must have taken place before the first day of that calendar month.


3. Prices and Rates


3.1 Subscription rates are determined and communicated annually.

3.2 Price changes may occur due to:

  • Inflation
  • Rising operational costs
  • Fuel costs
  • Other unforeseen circumstances that increase costs

3.3 Price changes will be announced in writing at least one month in advance.

3.4 All prices include 21% VAT.


4. Payment terms


4.1 Payment is made in advance, invoices are sent around the 1st of the month with a payment term of 14 days.

4.2 In case of late payment:

  • Is service suspended?
  • Is the Owner liable to pay statutory interest?
  • Will collection costs be borne by the Owner?


5. Subscription to Services


5.1 Subscription includes:

  • Fixed day(s) per week dog daycare
  • Monthly walking workshop
  • Free advice
  • Fixed discount on training courses

5.2 Holidays and vacation policy:

  • The schedule is announced monthly
  • Some holidays open, others closed
  • No refunds for corporate cancellations
  • Maximum 6 days per year (per fixed day) no availability due to holidays or public holidays

5.3 No possibility to catch up on missed days.

5.4 In extreme weather conditions (heat, cold, rain, snow, storms) that pose a risk to the dogs' safety, Hondbalans reserves the right to cancel, use an alternative such as a forest walk, or shorten the day. This will always be communicated.


6. Conditions of participation


6.1 Hondbalans reserves the right to refuse dogs that:

  • Not being social with people or other dogs
  • Missing required vaccinations
  • Not regularly treated against fleas and worms

6.2 Not allowed:

  • Bitches in heat
  • Uncastrated male dogs

6.3 All dogs must be vaccinated or titered annually, including for kennel cough.


7. Training and Behavioral Therapy


7.1 General provisions

  • Dog Balance offers effort obligations, not result obligations
  • The client acknowledges that results depend on the effort and cooperation of both the dog and the owner.

7.2 Validity and payment

  • Trainings and behavioral therapy sessions must be paid in full in advance
  • Purchased training courses are valid for 6 months after invoice date.
  • Unused training courses expire after 6 months, except in cases of force majeure.

7.3 Cancellation

  • Scheduled sessions must be cancelled at least 48 hours in advance
  • In case of late cancellation the full session will be charged

7.4 Intellectual property

  • All materials, methods and instructions supplied by Hondbalans are the property of Hondbalans.
  • It is not permitted to reproduce or share training materials without written permission.

7.5 Behavioral therapy specific

  • The customer is responsible for following advice and instructions
  • Hondbalans may terminate the agreement if instructions are repeatedly not followed


8. Liability


8.1 The owner remains liable for his/her dog at all times.

8.2 Compulsory third-party liability insurance for the dog.

8.3 In acute medical situations, Hondbalans may consult a veterinarian at the Owner's expense.

8.4 Hondbalans is not liable for:

  • Running away from dogs
  • Material damage after replacement
  • Dirt or wetness of the dog


9. Privacy and Data Protection


9.1 Personal data are processed in accordance with the GDPR:

  • Strictly confidential
  • Legal retention period is maintained

9.2 Customer rights:

  • Right of access
  • Right to correction
  • Right to erasure of personal data


10. Termination


10.1 Termination:

  • In writing or by email
  • At least one month in advance
  • No refunds for pre-paid periods


11. Applicable Law


11.1 Dutch law applies.

11.2 Disputes will be submitted to the competent court in the district of Hondbalans.


12. Final provisions


12.1 Hondbalans reserves the right to change these terms and conditions.

12.2 Changes will be communicated in writing at least one month in advance.
